02 / AI-Generated Content & Listening Rights

All audio broadcasts, track streams, voiceovers, and artwork on Overlooked FM are created using generative Artificial Intelligence (AI) technologies or provided by independent creators.

• Personal Use Only: Our stream is provided for your personal, non-commercial entertainment.
• Restrictions: You may not record, rebroadcast, sell, or commercially exploit any audio stream or material from this site without our explicit written permission.

03 / Submitting Your Music & Multi-Platform Promotional Rights

When you submit a track through our "Submit Your Track" form (submit.php), you retain full ownership of your original work. However, to help us promote your sound effectively, you grant Overlooked FM a non-exclusive, worldwide, royalty-free license to use your track across our official channels, including:

• Web & YouTube Live Streaming: Broadcasting your audio and associated artwork on our official web radio and continuous 24/7 YouTube live streams.
• YouTube Mixes & Compilations: Including your tracks in long-form audio mixes (e.g., 1-hour, 2-hour, or 10-hour curated showcases) published on our official YouTube channel.
• Spotify & External Streaming Playlists: Featuring your track in official Overlooked FM curated playlists on Spotify, Apple Music, or other streaming services (which may be included as part of featured promotion packages).
• Full Creator Credits: For any YouTube mix or playlist feature, we commit to providing full credits in the video description or tracklist, including direct links to your official YouTube channel or social profiles (provided you supplied them during submission).
• No Pay-for-Play Fees: Standard playlist rotation and broadcasts are provided without financial compensation or performance royalties paid to you or by you.

04 / AI Tools & Hybrid Works

If your music relies on AI tools (such as Suno, Udio, Midjourney, ElevenLabs, etc.) or mixes human creativity with AI:

• Commercial Rights: You promise that you have the right commercial license from the AI provider (for example, through an active paid subscription) to share, broadcast, and distribute the output.
• Hybrid Creations: You keep full copyright over your original human input (such as your own written lyrics, live vocals, or instruments), while granting us the right to stream and feature the finished hybrid track.
• Third-Party Policies: Overlooked FM is not responsible if a third-party AI platform changes its policies or raises a dispute regarding your source material.

05 / Direct Licensing & Collective Rights (No CMOs / PROs)

Overlooked FM operates strictly on a Direct Licensing model. By submitting audio to us, you explicitly confirm that:

• No CMO Involvement: Your submitted tracks are NOT registered with or managed by any Collective Management Organization (CMO) or Performance Rights Organization (PRO)—such as UCMR-ADA, CREDIDAM, UPFR (Romania), ASCAP, BMI (USA), SACEM (France), GEMA (Germany), or similar entities worldwide.
• Royalty Waiver: You waive any right to claim performance royalties, synchronization fees, or broadcasting fees through any CMO/PRO for plays occurring on Overlooked FM streams, YouTube channels, or Spotify playlists.
• Indemnification: If a copyright dispute or royalty claim arises from a third party regarding a track you submitted, you agree to take full responsibility and cover any costs or damages incurred by Overlooked FM.

06 / Track Removal & Takedown Policy (10-Day Notice)

We respect your rights as a creator. If you ever decide you want your music removed from Overlooked FM:

• How to Request: Send an explicit written takedown request to our official contact email.
• Security & Identity Verification: To prevent unauthorized removal requests, the email MUST be sent directly from the email address you used when originally submitting the track and must include:
  • Artist Name
  • Exact Track Title(s)
  • A clear statement requesting removal.
• Processing Time: Once verified, we will remove your track(s) from our active radio automation rotation, YouTube streams/mixes (where technical editing is feasible), and streaming playlists within maximum 10 business days.

07 / Our "Best Efforts" Commitment & Service Level

We love what we do and work hard to keep Overlooked FM running smoothly, but our service is provided on a "best efforts" and "as-is" basis:

• Free Promotions & Curations: Submitting a track doesn't automatically guarantee it will be broadcast or included in YouTube mixes. All submissions are subject to editorial review, station curation, and schedule availability.
• Uptime & Glitches: While we aim for 24/7 uninterrupted broadcasts, server maintenance, software updates, or unexpected outages can happen. We aren't liable for any temporary downtime or missed scheduled plays.

08 / Disclaimer & Limitation of Liability

Overlooked FM provides all content and features without warranties of any kind, express or implied. In no event will Overlooked FM, its creators, or operators be liable for any losses, data issues, or damages resulting from your use of (or inability to use) our streaming services or website.

09 / Changes to the Service & Terms

We reserve the right to update our broadcasting schedule, change site features, or modify these terms at any time. Continued use of the site after updates means you accept the revised terms.
